Consulting engineer in construction
A consulting engineer in construction is a highly qualified specialist who carries out independent quality control of works, technical supervision, performs advisory, organizational and technical functions to ensure the successful implementation of a construction project. His goal is to help the customer achieve the highest quality of construction works, deadlines for their completion and cost optimization.
A consulting engineer fully supports the project at all stages of construction until its acceptance by the customer, including the preparation of initial data for design documentation for the construction of the facility. Under the leadership of a consulting engineer, work is organized at the construction site, including installation and repair and construction work. He also participates in the analysis of claims that have arisen between project participants, controls the expenditure of funds for construction, in accordance with the concluded contract.
Who is a consulting engineer and why is he important?
A consulting engineer plays a key role in new construction, reconstruction, and renovation within international construction practice. They provide professional support, supervision, and oversight at all stages of project implementation. Their knowledge, experience, and ability to adapt to different legal systems and standards help ensure the successful delivery of construction projects at an international level.
A consulting engineer acts as an expert who advises the client on the implementation of a construction project, the selection of suppliers and contractors, and the management of construction activities on site. They also monitor the organizational and technological reliability of construction processes and assess the validity of conclusions issued by public authorities.
In Ukraine, the profession of “Consulting Engineer (Construction)” was included in the National Classification of Occupations of Ukraine DK 003:2010 only in 2017, in accordance with Order No. 1542 of the Ministry of Economic Development and Trade of Ukraine dated October 26, 2017.
In Europe, an independent consulting engineer is a key figure in the development strategy of the construction business. Their involvement helps ensure objective assessment and compliance with high construction standards, which is especially important for projects financed by international organizations and banks.
The leading organization in the field of construction consulting is the International Federation of Consulting Engineers (FIDIC), which unites national associations and develops standard forms of contracts and guidelines for construction projects. The use of FIDIC contracts helps improve construction quality and ensures a clear allocation of responsibilities among project participants.
Services of a Consulting Engineer
The engagement of a consulting engineer is possible at all stages of construction: from pre-design activities to the completion of the construction project.
A consulting engineer in construction participates in the development of the necessary measures, project risk management, and promotes the rational use of resources. In particular, their responsibilities may include the following:
- ensuring that design documentation complies with applicable standards;
- organizing work on the construction site;
- monitoring work schedules, the client’s costs, and the quality of completed construction works;
- participating in technical supervision throughout the entire construction period;
- analyzing inspection results and assessing the validity of conclusions issued by public authorities;
- mediation — resolving disputes that arise between project participants.
Form of Agreement Between the Client and the Consulting Engineer
Order No. 787 of the Ministry for Communities, Territories and Infrastructure Development of Ukraine dated August 6, 2024, “On Approval of Model Forms of Agreements for the Provision of Engineering and Consulting Services in Construction, for the Provision of Engineering and Consulting Services in Construction (Consulting Engineer Services), and for Technical Supervision in Construction,” approved the relevant model documents regulating the terms of cooperation between the client and the consulting engineer.
At the same time, Ukrainian legislation allows construction contracts to be concluded in accordance with international standards and forms, for example, by applying standard FIDIC contract forms, provided that they comply with national legal requirements and are properly adapted to Ukrainian legislation.
For foreign economic construction contracts concluded with foreign business entities, the parties may use international customs and recommendations of international organizations.
Consulting engineers may have different specializations depending on the type of facility and the specific nature of the project. The main categories include:
- A consulting engineer for general construction manages and supervises the construction of residential, commercial, and industrial facilities.
- A consulting engineer for road construction specializes in infrastructure projects such as roads, bridges, and transport interchanges.
- A consulting engineer for environmental construction ensures the environmental safety of projects and the implementation of modern technologies.
Classification by consequence classes helps determine the requirements for the specialist and ensures the appropriate level of control for each type of facility.
- CC1: buildings with a low level of risk to human life. Tasks: monitoring compliance of works with design documentation, checking the quality of materials, and ensuring compliance with applicable standards.
- CC2: facilities with a medium level of risk. Tasks: managing interaction between contractors, monitoring deadlines and costs.
- CC3: high-rise buildings and critical infrastructure. Tasks: implementing modern supervision methods, coordinating numerous project participants, and ensuring safety.
How Prices for Consulting Engineer Services Are Formed
The cost of consulting engineer services and technical supervision is determined in accordance with the Guidelines for Determining the Cost of Construction (hereinafter referred to as the Guidelines), approved by Order No. 281 of the Ministry for Communities and Territories Development of Ukraine dated November 1, 2021. At the stage of preparing investor cost estimate documentation, the cost of such services is determined as a percentage of the total of Chapters 1–9 of the consolidated cost estimate for the facility.
In addition, Order No. 244 of the Ministry for Communities and Territories Development of Ukraine dated December 1, 2022 approved Amendment No. 2 to the Guidelines, which introduced updates regarding engineering and consulting services:
– the percentage amount of funds for maintaining the client’s service, performing technical supervision, and providing consulting engineer services was clearly defined;
– it was established that the amount of funds for technical supervision and consulting engineer services is determined without taking into account the cost of technological equipment, including medical equipment, as well as furniture and inventory;
– the amount of funds for consulting engineer services stipulated by the relevant agreement is determined depending on the stage at which the consulting engineer is engaged;
– the Guidelines for Determining the Cost of Construction were supplemented with Appendix 42, which establishes indicators for determining the cost of consulting engineer services at different stages of project implementation and details their functions at each stage;
– in addition, a consulting engineer may be engaged for separate stages/types of work with payment in accordance with Appendix 47 to the Guidelines;

- new construction of the Inhulets River–Southern Reservoir main water pipeline to supply water to the city of Kryvyi Rih due to the need to mitigate the negative consequences caused by the destruction of the Kakhovka Hydroelectric Power Plant, Dnipropetrovsk Region;

- major repair of the bridge crossing over the canal at km 29+110 of the R-69 Kyiv–Vyshhorod–Desna–Chernihiv public highway of national importance, Kyiv Region;
- major repair of the bridge crossing over the Teteriv River at km 37+210 of the T-10-05 Ivankiv–/M-07/ public highway of national importance, Kyiv Region;
- major repair of the overpass at km 54+863 of the T-10-19 Fenevychi–Borodianka–Makariv–Byshiv public highway of national importance, Kyiv Region;
- major repair of the bridge crossing over the Teteriv River at km 78+850 of the M-07 Kyiv–Kovel–Yahodyn public highway of national importance, towards Lublin, Kyiv Region;
- major repair of the bridge crossing over the Teteriv River at km 79+110 of the R-02 Kyiv–Ivankiv–Ovruch public highway of national importance, Kyiv Region;
- construction of a dual-purpose facility with the protective properties of a radiation shelter for the I–III grade general secondary education institution “Specialized School No. 3 with Advanced Study of Information Technologies” in the Podilskyi District of Kyiv;
